Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of the VetTrack Pet website, mobile applications, and other services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Services.

1. Account Registration

To use certain features of the Services, you may need to register for an account. When you register for an account, you agree to:

• Provide accurate, current, and complete information about yourself
• Maintain the security of your account credentials
• Promptly update any information if it changes
• Accept responsibility for all activities that occur under your account

2. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

3. Use of the Services

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services in any way that violates any applicable federal, state, local, or international law or regulation
• Impersonate or attempt to impersonate VetTrack Pet, a VetTrack Pet employee, another user, or any other person or entity
• Use the Services to transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• Access, tamper with, or use non-public areas of the Services, our computer systems, or the technical delivery systems of our providers
• Attempt to probe, scan, or test the vulnerability of any VetTrack Pet system or network or breach any security or authentication measures
• Attempt to access or search the Services or download content from the Services using any engine, software, tool, agent, device, or mechanism other than the software and/or search agents provided by VetTrack Pet

4. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by VetTrack Pet, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
• You may store files that are automatically cached by your Web browser for display enhancement purposes
• You may print or download one copy of a reasonable number of pages of the Services for your own personal, non-commercial use and not for further reproduction, publication, or distribution

5. User Content

The Services may allow you to submit, post, display, or transmit content ("User Content"), including but not limited to your pet's health information, photos, and other materials.

By submitting User Content to the Services, you grant VetTrack Pet a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Services and VetTrack Pet's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels.

You represent and warrant that:

• You own or control all rights in and to the User Content and have the right to grant the license granted above to VetTrack Pet and its affiliates and service providers, and their respective licensees, successors, and assigns
• All of your User Content does and will comply with these Terms

6. Privacy

Your privacy is important to us. Please read our Privacy Policy to understand how we collect, use, and share information about you and your pet.

7. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may do so by following the instructions on the Services.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

VetTrack Pet does not warrant that the Services will be uninterrupted, secure, or error-free; that any defects or errors will be corrected; or that the Services or the server that makes it available are free of viruses or other harmful components.

9. Limitation of Liability

IN NO EVENT SHALL VETTRACK PET, ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

IN NO EVENT SHALL THE TOTAL LIABILITY OF VETTRACK PET ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SERVICES EXCEED THE AMOUNTS YOU HAVE PAID TO VETTRACK PET FOR ACCESS TO OR USE OF THE SERVICES IN THE TWELVE (12) MONTHS PRIOR TO THE INCIDENT GIVING RISE TO THE LIABILITY.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

11. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page.
